In an announcement, the SEC stated its grievance alleges that the Gemini Earn program constitutes a suggestion and sale of securities and will have been registered with the fee.
“We allege that Genesis and Gemini provided unregistered securities to the general public, bypassing disclosure necessities designed to guard traders,” SEC Chair Gary Gensler stated in a statement.
Gensler added the fees “construct on earlier actions to clarify to {the marketplace} and the investing public that crypto lending platforms and different intermediaries have to adjust to our time-tested securities legal guidelines.”
